SMS & Messaging Terms

These terms describe the text-message (SMS) programs operated by American Polling Company, LLC (“American Polling Company,” “we,” “us”), including messages we send for public opinion research and messages we send on behalf of client organizations under their registered messaging campaigns.
Program description
American Polling Company uses SMS for two purposes:
- Research invitations. Invitations to participate in a public opinion survey, which may include a secure link to the survey. These are sent to people included in a research sample.
- Client programs.Messages sent on behalf of a client campaign, committee, or organization under that client’s own registered 10DLC messaging campaign, where American Polling Company acts as the sending provider. The message identifies the sending organization.

How consent is obtained
We send messages only where there is a lawful basis to contact the recipient. [Describe the exact consent basis for each program, for example prior express consent, the recipient’s relationship to the sending client, or the basis on which a research sample is contacted, and how and where that consent or basis is captured and recorded. This is a legal and carrier- compliance determination and must be completed and reviewed before registration.]
We do not require you to receive text messages as a condition of any purchase. [Confirm this statement is accurate for every program].
Message frequency
Message frequency varies by program. [State the expected frequency for each program, for example “recurring messages, up to N per survey or campaign,” consistent with what is registered].
Cost
Message and data rates may apply. American Polling Company does not charge for the messages themselves; your mobile carrier’s standard rates apply.
How to get help
Reply HELP to any message for assistance, or contact us at [support email] or [support phone, if offered]. A HELP reply will return contact information and basic instructions.
How to stop messages
Reply STOP to any message to unsubscribe. After you reply STOP, we stop sending you messages for that program. American Polling Company honors opt-out requests permanently and across future programs, so once you opt out you will not be re-contacted by SMS unless you later opt back in.
Privacy
We do not sell or share mobile opt-in information or messaging consent with third parties or affiliates for their own marketing or promotional purposes. Mobile information is used only to operate the messaging program you consented to and to honor opt-out requests. See our Privacy Policy for full details.
Carriers
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier and device conditions.
